AVANTA YACHT CHARTERS – BROKER & CHARTER CLARIFICATION RIDER
1. Broker Status & Role
Avanta Yacht Charters (“Broker”) acts solely as an independent intermediary between the Charterer and the Yacht Owner/Operator.
The Broker:

Does not own, manage, operate, or control any yacht

Does not employ the Captain or Crew
-
Does not guarantee performance of the yacht or crew
All services are provided by independent third parties.
2. Contractual Relationship
The Charterer acknowledges that:
The charter agreement is directly between the Charterer and the Yacht Owner/Operator, not the Broker.
The Broker is not a party to:

Yacht operations
-
Crew employment
-
Onboard services
3. APA (Advance Provisioning Allowance) – Dispute Shield
The Charterer understands that:

APA funds are held and administered by the Captain or Yacht Management Company

The Broker has no control, custody, or responsibility over APA expenditures
The Charterer agrees:

All APA disputes must be resolved directly with the Captain or Yacht Manager

The Broker shall not be liable for:

Overspending

Underspending

Allocation disputes

Quality or pricing of provisions

4. Crew & Onboard Experience Disclaimer
The Broker makes recommendations based on experience and industry knowledge.
However, the Charterer acknowledges:

Crew are independent contractors or employees of the Yacht Owner

The Broker does not supervise or control crew conduct
The Broker is not liable for:

Service quality
-
Personality compatibility
-
Food, beverage, or itinerary preferences

Guest satisfaction onboard
5. Force Majeure
Neither the Broker nor the Yacht Owner shall be liable for failure or delay due to events beyond reasonable control, including but not limited to:

Weather events or hurricanes

Mechanical failure
-
Crew illness or incapacity
-
Government actions, travel restrictions, or border closures

Acts of God

Epidemics, pandemics, or public health events

Port authority restrictions
In such cases:

Alternative arrangements may be offered where possible

Refunds or rescheduling are governed strictly by the underlying charter agreement
6. Limitation of Broker Liability
To the fullest extent permitted by law:
The Broker’s total liability shall not exceed the commission received for the charter.
The Broker shall not be liable for:

Travel disruptions

Indirect or consequential damages
7. Indemnification
The Charterer agrees to indemnify and hold harmless the Broker from any claims arising from:

Charter participation

REFUNDS & NON-REFUNDABILITY

Charter Payments & Refund Policy
All charter payments are subject to the terms of the underlying charter agreement (e.g., CYBA or MYBA).
Unless otherwise stated in the charter agreement:
Charter payments are generally non-refundable once paid.
In the event of cancellation:
Refunds, if any, depend on:

Timing of cancellation

Whether the yacht is successfully rebooked

Terms agreed with the yacht owner

Avanta Yacht Charters does not guarantee refunds under any circumstances.
CANCELLATION POLICY:
Charter Cancellation Policy
If a Charterer cancels a confirmed booking:
All payments made remain due and payable
The yacht may be remarketed for the same period
If the yacht is rebooked:
A partial refund may be issued
Less:
A minimum 20% cancellation fee
Any incurred expenses
If the yacht is not rebooked:
No refund will be issued.
All cancellations must be submitted in writing.
FORCE MAJEURE
Force Majeure & Travel Disruptions
Yacht charters are subject to events beyond control, including:
Weather (including hurricanes)
Mechanical issues
Government restrictions
Travel disruptions or border closures
In such cases:
Delays or itinerary changes may occur
Refunds or credits are governed strictly by the charter agreement
Avanta Yacht Charters is not responsible for any additional costs, losses, or missed travel arrangements.
TRAVEL & EXPENSE DISCLAIMER
Travel & Ancillary Expenses
Charterers are solely responsible for:
Flights
Hotels
Transfers
Travel-related expenses
We strongly recommend booking refundable travel or purchasing travel insurance.
Avanta Yacht Charters is not liable for:
Missed flights
Delays
Additional travel costs
TRAVEL INSURANCE
Travel Insurance Recommendation
We strongly recommend purchasing comprehensive travel insurance, including:
Trip cancellation
“Cancel For Any Reason” (CFAR) coverage
Medical and evacuation coverage
If you choose not to purchase insurance:
You assume full financial responsibility for any losses.
CAPTAIN AUTHORITY
Captain’s Authority
The Captain has absolute authority over:
Safety
Navigation
Itinerary adjustments
Use of water toys and onboard activities
This authority overrides guest preferences when safety is concerned.
APA & ONBOARD EXPENSES
Onboard Expenses & Additional Costs
Certain expenses may not be included in the charter fee, such as:
Premium alcohol
Dockage requested by guests
Special provisions
Off-yacht excursions
These are:
Settled onboard directly with the Captain.
Avanta Yacht Charters has no control over these expenses.
HIGH-RISK ACTIVITIES LIABILITY
Water Sports & Activity Risk
Charterers and guests participate in activities at their own risk, including:
Swimming
Snorkeling
Scuba diving
Water sports
Avanta Yacht Charters is not liable for:
Injury
Accidents
Loss or damage
ZERO-TOLERANCE DRUG POLICY
Illegal Substances Policy
Yachts operate under strict international maritime laws.
The possession or use of illegal drugs or controlled substances is strictly prohibited.
Violation may result in:
Immediate termination of the charter
No refund
Possible legal consequences
COMPLAINT RESOLUTION
Complaint Procedure
Any concerns during a charter must be:
Reported immediately to the Captain
Escalated through Avanta Yacht Charters within 48 hours
Failure to report issues during the charter:
May limit the ability to resolve or claim compensation.
